Terms of Service

1. Acceptance of Terms
By accessing or using LanguageReps ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is strictly intended for individuals 18 years of age or older. By using the Service, you represent that you are at least 18 years old.
2. Use of the Service
LanguageReps is an AI-powered language learning platform. You may use the Service for personal, non-commercial language learning purposes. You agree not to misuse the Service, attempt to circumvent usage limits, use automated scripts or bots, or use the Service to generate harmful content. We reserve the right to throttle, limit, or suspend accounts that generate traffic exceeding normal human learning patterns or that impose disproportionate infrastructure costs.
3. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use at hello@languagereps.app.
4. Subscriptions, Billing and Auto-Renewal
Paid plans are billed in advance on a weekly, monthly, or annual basis and automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You authorise us, via our payment processor Stripe, to charge the applicable fee to your payment method at each renewal. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods unless required by applicable law or as described in Section 5.
5. Right of Withdrawal and Refund Policy
As a consumer in the EU/EEA, you generally have a 14-day statutory right of withdrawal under German law (§ 312g BGB) for distance contracts. However, because LanguageReps provides digital content delivered immediately upon purchase, you expressly consent to the immediate commencement of the Service and acknowledge that you thereby waive your statutory right of withdrawal once your first lesson or content has been delivered (§ 356 Abs. 5 BGB). Notwithstanding this waiver, LanguageReps voluntarily offers a 14-day money-back guarantee from the date of your initial purchase. If you are not satisfied, contact us at hello@languagereps.app within 14 days for a full refund.
6. AI-Generated Content
Lessons, exercises, and explanations are generated by artificial intelligence (including large language models provided by Google and third-party API providers) and are intended solely for educational purposes. AI-generated content may occasionally contain linguistic errors, grammatical inaccuracies, or factually incorrect statements ("hallucinations"). LanguageReps does not warrant the accuracy, completeness, or cultural appropriateness of any AI-generated material and is not liable for any damages arising from your reliance on it.
7. Third-Party Services
The Service relies on third-party providers including Stripe (payments), Cloudflare, and AI model providers to function. LanguageReps is not responsible for service interruptions, data loss, or other issues caused by these third-party providers. Your use of payment services is also subject to Stripe's terms of service.
8. Intellectual Property
The LanguageReps platform, branding, and underlying technology are the exclusive property of LanguageReps and its licensors. You grant us a limited, non-exclusive licence to process the content you submit solely to provide the Service to you.
9. Limitation of Liability
LanguageReps is provided "as is" without warranties of any kind. To the maximum extent permitted by German law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability shall not exceed the greater of €100 or the total fees you paid to LanguageReps in the twelve months preceding the claim. Nothing in these Terms limits liability for damages arising from intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), injury to life, body or health, or any other liability that cannot be excluded under mandatory German law.
10. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Germany. If you are a consumer resident in another EU member state, you retain the right to bring proceedings in your country of residence.
